APPLICANT REQUESTS THAT:

He be awarded the Air Medal (AM).

APPLICANT CONTENDS THAT:

He flew 100 missions over Korea from Brady Field, Kysha, Japan between Aug 52 and Jan 53. 

The applicant’s complete submission is at Exhibit A.

STATEMENT OF FACTS:

The applicant initially entered the Air Force on 20 Jan 51.  

On 20 Jun 52, the applicant was discharged from active duty and entered the Air Force Reserve.  

On 20 Jun 55, the applicant was furnished an Honorable discharge and credited with 4 years, 4 months, and 21 days of total active service.  

On 16 Sep 13, AFPC/DPSIDRA administratively corrected the applicant’s official military record to reflect the applicant was awarded the Good Conduct Medal (GCM).

AIR FORCE EVALUATION:

AFPC/DPSID recommends denial due to the timeliness of the submission.  The AM may be awarded to any person who, while serving in any capacity with the United States Armed Forces, subsequent to 8 Sep 39, distinguishes himself or herself by meritorious achievement while participating in aerial flight.  The AM may be awarded for combat or non-combat action in recognition of single acts of valor, heroism, or merit while participating in aerial flight.  Additionally, it may be conferred for sustained meritorious achievement (distinction) in the performance of duties involving aerial flight.  The applicant is requesting award of the AM for actions that took place during the Korean War over 60 years ago.  He has a limited official military personnel record, consisting of two Reports of Separation from the Armed Forces of the United States (DD Form 214), dated 20 Jun 52 and 20 Jun 55.  A review of his records failed to reveal any evidence indicating the applicant was awarded the AM, the number of missions completed by the applicant, or the applicant’s unit of assignment during the Korean Conflict.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:

A copy of the Air Force evaluation was forwarded to the applicant on 18 Oct 13 for review and comment within 30 days.  As of this date, no response has been received by this office (Exhibit D).

THE BOARD CONCLUDES THAT:

1.  The applicant has exhausted all remedies provided by existing law or regulations.

2.  The application was not timely filed; however, it is in the interest of justice to excuse the failure to timely file.

3.  Insufficient relevant evidence has been presented to demonstrate the existence of an error or injustice.  We took notice of the applicant’s complete submission in judging the merits of the case; however, we agree with the opinion and recommendation of the Air Force office of primary responsibility (OPR) and adopt its rationale as the basis for our conclusion the applicant has not been the victim of an error of injustice.  Therefore, in the absence of evidence to the contrary, we find no basis to recommend granting the relief.

THE BOARD DETERMINES THAT:

The applicant be notified the evidence presented did not demonstrate the existence of material error or injustice; the application was denied without a personal appearance; and the application will only be reconsidered upon the submission of newly discovered relevant evidence not considered with this application.
